ENVIRONMENTAL DETERMINATION
The Director of the Department of Planning and Development (DPD) has determined that the Master Plan is likely to have a significant adverse environmental impact and has issued a Declaration of Significance.
Environmental documents for this project have been prepared by DPD.
DPD published a notice of availability of the Final Environmental Impact Statement (FEIS) on November 10, 2008. The DPD Director determined that the Final Environmental Impact Statement (FEIS) adequately described and assessed the adverse impacts of the Master Plan and that the Master Plan had been conditioned to mitigate impacts.
The Laurelhurst Community Club appealed the adequacy determination, and DPD published a notice of appeal on December 15, 2008. The Hearing Examiner held an appeal hearing beginning on March 5, 2009.
On April 20, 2009, the Hearing Examiner issued her Findings and Decision reversing the Director’s determination that the FEIS issued for the proposal is adequate as the FEIS fails to present a reasonably thorough discussion of probable significant housing and land use impacts. The Hearing Examiner found that the FEIS presents a reasonably thorough discussion of the probable significant impacts on aesthetics (height, bulk and scale), and on transportation.
In response, DPD prepared a Revised Final Environmental Impact Statement (Revised FEIS) which incorporated by reference all information contained in the November 10, 2008 FEIS, and which focused only on new information related to land use and housing. DPD published a notice of availability of the Revised FEIS on May 28, 2009. The DPD Director determined that the Revised FEIS adequately describes and assesses the adverse impacts of the Master Plan and that the Master Plan has been conditioned to mitigate impacts.
The Hearing Examiner has scheduled a hearing on the Director’s Recommendation to begin on July 14, 2009, at 9:00 AM. Any appeals of the adequacy of the Revised Final EIS will be combined with the hearing on the Director’s recommendation to the Hearing Examiner of the Major Institution Master Plan.
