Conditions:

The City of Seattle Hearing Examiner is conducting a public hearing on the recommendation of the Director of the Department of Planning and Development (DPD) to rezone property from IC 65' to NC3-85’.

Project Description:  Proposal includes a 6-story building containing 696,000 sq. ft. of retail, 45,000 sq. ft. of administrative office and 565 residential units in residential towers above the commercial bases. Parking for 2,307 vehicles to be provided within the structures. Project includes demolition of all structures on site and 260,000 cu. yds. of grading.

The Director's recommendation is that the rezone be conditionally approved. Conditions include: signal improvements to intersections of Rainier/Dearborn and to Rainier/Weller; contribution to traffic improvements in Jackson Place neighborhood; transportation management program; construction of commercial project with residential units as proposed in project application; sign plan, numerous design related conditions.

ENVIRONMENTAL DETERMINATION

The Director of DPD has determined that the Final Supplemental Environmental Impact Statement (FSEIS) adequately describes and assesses the adverse impacts of the rezone and proposed development and that they been conditioned to mitigate impacts.

DESIGN REVIEW

The Design Review is conditionally approved.  Numerous conditions - please see report in project file.

PUBLIC HEARING

A public hearing to take public comment on the Director's recommendation and to establish the record for this application will be held on: June 9, 2008 at 10:00 a.m. at the Office of the Hearing Examiner (address below). The Office of the Hearing Examiner provides barrier free access.

HOW TO APPEAL THE ENVIRONMENTAL DETERMINATION AND/OR DESIGN REVIEW

Appeals of the decision to issue a Declaration of Non-Significance and/or Design Review must be received by the Hearing Examiner at the address shown above no later than 5:00 p.m. May 15, 2008. Appeals must be accompanied by $50.00 filing fee in a check payable to the City of Seattle. Any appeal of the decision will be heard at the public hearing on June 9, 2008.
